Arbitration

The arbitrator's award is final and may be entered in any court with jurisdiction. The prevailing party may recover its costs and reasonable attorney fees. This arbitration provision survives termination of these Terms.

Class Action Waiver

Arbitration will take place only on an individual basis. Class, collective, and representative actions are not permitted. Each party may bring claims only in its individual capacity, and an arbitrator may not consolidate multiple people's claims unless both parties agree otherwise.

Liability Disclaimer

The information, software, products, and services available through the site may contain inaccuracies or typographical errors and may change at any time. To the maximum extent permitted by law, they are provided "as is" without warranty or condition of any kind.

To the maximum extent permitted by law, AccessFuel, Inc. and its suppliers are not liable for direct, indirect, punitive, incidental, special, or consequential damages, including loss of use, data, or profits, arising from the use of or inability to use the site or related services.

Some jurisdictions do not allow certain exclusions or limitations, so portions of this limitation may not apply to you. If you are dissatisfied with the site or these Terms, your sole remedy is to stop using the site.

Termination and Access Restriction

AccessFuel may terminate access to the site or related services at any time without notice. To the maximum extent permitted by law, these Terms are governed by California law, and you consent to the exclusive jurisdiction and venue of courts in California.

If any part of these Terms is found invalid or unenforceable, it will be replaced by a valid provision that most closely matches its intent, and the remainder will continue in effect.

These Terms constitute the entire agreement between you and AccessFuel regarding the site and supersede prior or contemporaneous communications and proposals.
